Puffer’s Gary Byers Sound & Lighting Trademark Application Almost Refused

Wednesday, December 21, 2016: Puffer’s Gary Byers Sound & Lighting  Trademark Application Almost Refused Due To Likelihood of Confusion with member of Seven Dwarfs

In September 2016, the Puffer Hockey League announced that Gary Byers would be awarded an team. The team announced its name in October, the “Gary Byers Sound and  Lighting.”

But just a few weeks later, on December 7, the team’s trademark application for the "little dude on the shoulder" in connection with “entertainment services, namely, ice hockey exhibitions” was almost refused by the Patent and Trademark office  as likely to be confused with a registered trademark for "Happy" of the 7 dwarfs.

The examining attorney perceived the “man with a hat” portion of the shoulder patch to be dominant and confusingly similar in both appearance and with respect to the nature and trade channels of services. According to the examiner, the stylization of the registered “man running with equipment” mark appeared larger and centered, causing much confusion.

In the end, the examining attorney found the marks identical in their most prominent portions and confusingly similar when compared as a whole. However since the Jerseys
were already printed, the examining attorney determined that it was probably going to be okay.

Puffer Trade Tracker News

OWEN SOUND - SEPTEMBER 21, 2016: BYERS and LOZON STILL TRADED

In a deal which lent credence to the rumors that The Owen Sound Puffer League needed a new sponsor before opening day, Shorty's Bar and Grill  traded Gary Byers of Gary Byers Sound and Lighting to Gary Byers Sound and Lighting Wednesday for historically perennial trade bait left winger Al Lozon.

While League President Jay McMullin insisted the trade was a hockey decision and he may be right that the Gary Byers Sound and Lighting will be a better team having the actual sponsor on the team -  the trade was a tacit admission that Lozon's over-the-top personality was a distraction.

Rumors of an impending trade have been swirling for several weeks and Byer's said he wasn't surprised.

"Obviously, it's a bit surreal, but it happened like 9 weeks ago," Byers said in a conference call.

While Lozon seemed to be confused as to what team he is on  with more than a 1/3 of season underway, he hinted that he has actually been to Shorty's the restaurant in the past and was pretty sure he did know where to park there.

"I'm just happy to be in a situation where I can excel and feel good about myself coming to the rink," he said. He went on to say that he felt closer to winning the Puffer Cup with Shorty's.

Thom's rookie Aishford becoming must-watch player

OWEN SOUND, ONT. -- Puffer President-Elect  Jay McMullin's  phone was buzzing with text messages from friends and family members in his hometown of  Leith. They all wanted to know about Aishford   for Thom's Construction and what's up with that ridiculous backhanded shot?

Glenn A. Aishford
That's  Glenn A. Aishford , Thom's 62-year-old rookie forward, McMullin told them, and that backhand is only one of the weapons in his arsenal.

"Everybody is talking about him back home," McMullin's   said. "He's got a lot of speed, some sick hands and that shot. His backhanded shot is probably one of the best in this League. Unbelievable. So hard. He's got a lot of good things going on."

Aishford  is turning heads around the world with an array of attributes that have made him an instant must-watch player in Puffer. The backhand in question was on display against Shorty's on Jan 13, when he used it to send a hard, soaring shot off the back of his blade that had enough speed and height to fool goalie Richard Noon.
